Resincoat Ltd Terms and Conditions for Online Sales
PLEASE READ THE TERMS AND CONDITIONS CAREFULLY BEFORE PLACING AN ORDER FROM RESINCOAT LTD AND RETAIN A COPY OF THEM AND YOUR ORDER FOR FUTURE REFERENCE.
BY CONTINUING WITH A PURCHASE IT IS DEEMED THAT YOU HAVE READ, UNDERSTOOD AND AGREE TO THESE TERMS AND CONDITIONS.
Terms
The terms of sale set out here apply to goods supplied by Resincoat Ltd, ordered from the Resincoat Ltd website at www.resincoat.co.uk. By continuing with a purchase it is deemed that you have read, understood and agree to these terms and conditions.
You must be 16 years of age or older to order from the website and by accepting these terms and conditions you are confirming this.
Resincoat Ltd reserves the right to change these Terms and Conditions without notice to you in relation to future sales.
These terms do not create any rights to any parties other than the purchaser.
Orders and Prices
Resincoat Ltd use Stripe as their online purchasing system.
Resincoat Ltd accepts payment by any of the credit card shown as acceptable on the website at time of purchase.
All prices are shown in UK pounds sterling and are subject to VAT and delivery charges unless otherwise stated. These charges where applicable will be added on confirmation of your address and payment details and prior to the order being placed during the payment process.
The description and price of goods will be as shown on the website at the time you place your order. Every effort will be made to ensure that prices shown on the website are accurate at the time of purchase. If an error is discovered prior to dispatch of your order, Resincoat Ltd will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or canceling your order.
When ordering online your order will be sent to Resincoat Ltd through Stripe by email. You will also receive an email receipt to confirm Resincoat Ltd has received your order. Should you not receive an email please contact Resincoat Ltd on 0113 827 2387
Orders of goods shown on the website can also be placed by telephone or email.
Resincoat Ltd currently have the ability to supply goods to destinations other than the UK. If you are shopping from outside the UK, please contact the Resincoat Ltd to place your order as terms and conditions, shipping prices and delivery times will differ to those stated on our website. Should you need to amend or cancel your order this must be done within 24 hours of placing the order, changes and/or cancellations after this time may not be possible and may be subject to further charges
All goods are subject to availability. If on receipt of your order the goods are out of stock, Resincoat Ltd will inform you and refund or re-credit you for any sum that has been paid by you for the unavailable goods.
All payments for goods or services will be paid at point of sale.
Resincoat Ltd is under no obligation to accept any order.
Delivery
All delivery times quoted on the Resincoat Ltd website are estimates based on normal processing and the availability of the Courier Company. Resincoat Ltd delivery prices are based on weight, and the same order may be split separately but will charge for postage and packing as per the original order.
Deliveries to areas outside of mainland UK including but not limited to Northern Ireland, Republic of Ireland, Scotland, Jersey will incur an additional charge which is calculated with the courier at the time of ordering. When placing an order from those locations customer should contact the Resincoat sales office for a quotation.
Goods ordered from our website or via phone or email, will be delivered to the delivery address you provided at the time the order is placed, subject to receipt of an order confirmation email, unless otherwise arranged with Resincoat Ltd at the time of the order, or for you to collect the order in person from Resincoat Ltd.
Resincoat Ltd will endeavour to deliver goods purchased within 5 - 7 working days of receipt of payment unless otherwise stated on the website, or ad1vised by email at the time of purchase.
Next working day delivery is available for an extra charge. Orders placed after 2:00pm on a working will not qualify for next working day delivery and will be dispatched the following day. Resincoat Ltd cannot guarantee that goods will arrive next day.
If there is no one available at the delivery address to accept delivery of couriered goods, you will be notified of an alternative delivery date or place to collect the goods. Resincoat Ltd cannot accept responsibility for goods that are returned to the Courier and remain uncollected.
A signature will be required on delivery for couriered and special delivery purchases. Receipt of a signature at the delivery address for any order will act as proof that the order has been delivered to you.
Once an order is considered delivered responsibility for the goods, risk of damage or loss will pass to you.
If Resincoat Ltd are unable to deliver your order within 30 days, we will inform you as soon as possible and you will be entitled to cancel the order and obtain a full refund that will be paid to the credit or debit card with which you originally paid for your order.
Resincoat Ltd is not liable for any loss or damage suffered by you through any unavoidable delay in delivery of an order. Resincoat Ltd is not liable for any damage which occurs to an order after a delivery has been made.
The Company uses Third Party distributors to deliver its products. Resincoat Ltd will do all in its power to deliver the goods ordered as soon as practicable, notwithstanding matters arising that are out of the Company’s control.
Any time or date named by Resincoat Ltd for delivery is given and intended as an estimate only and The Company shall not be liable to make good any damage or loss, material or financial whether arising directly or indirectly out of the delay in delivery.
The Company cannot be held responsible for Resincoat Ltd goods in transit with a Third Party.
Delivery Dates
In the absence of special arrangements to the contrary, the company shall not give the buyer any prearranged dates for delivery, but delivery shall be affected in accordance with the terms and conditions 3 hereof.
Any complaint of short delivery, quality or of damage to goods in transit must be notified to the company in writing otherwise then a consignment note or delivery document within 72 hours of receipt of goods and any complaint of failure to deliver goods invoice must be notified within 7 days of the date of the invoice.
Variations
Variations in quantity, gauge, colour or size not exceeding plus or minus 10% will be considered due execution of the contract except when the product is specially ordered where there maybe additional variations, the amount of which will be governed by the quality of the product delivered by the company. Quantity variations will be charged pro rata.
Coverage
Our estimated coverage rates are given on the understanding that we do not know the following facts.
1. The exact condition of the surface to be painted.
2. The ambient temperature of the surface and air in the work area.
3. The Equipment used.
4. The expertise of the person applying the Product.
5. The exact coverage rate of the products bought, given the above (items 1-4)
Notwithstanding the above, we will do our best to help you achieve the best result.
Return of Goods
It is our general policy not to accept return of goods. In exceptional circumstances standard products may be returned to us within 14 days of date of delivery provided that the customer has written agreement from Resincoat Ltd to such a return. No claims will be entertained for returns outside this period. Goods are to be returned at the customer’s expense to the original source of supply as specified by Resincoat Ltd and a re-stocking charge of 35% will be made for goods that are of merchantable quality as determined by Resincoat Ltd. Not all goods may be accepted back into stock for credit. All B2B transactions will be charged at a 50% restocking rate.
Defective Goods
Goods represented by the customer to be defective shall not form the subject of any claim for work done by the customer or for any loss, damage or expense whatsoever arising directly or indirectly from such defects, but such goods, if returned to Resincoat Ltd and accepted by them as defective, will at the request of the customer and if practicable be replaced as originally ordered. Defects in quality or dimensions in any delivery shall not be a ground for cancellation of the remainder of the order or contract.
Resincoat will not be held responsible for coating failure due to poor/contaminated substrate. Reticulation of coating (orange peel effect) can occur if chemicals/latents remain in the substrate after preparation.
If coatings are applied to tolerances outside of the recommended Technical data sheet levels, Resincoat will not be held responsible for coating failure.
Resincoats coating systems are rigorously tested before despatch and will not be released unless they meet our stringent quality parameters.
Conditions
No forbearance or indulgence by the company shown or granted to the buyer whether in respect of these general conditions or otherwise shall in any way affect or prejudice the rights of the company against the buyer or be regarded as a waiver of any of these general conditions.
No servant or agent of Resincoat Ltd has power unless agreed to by a Director in writing. (a) To vary these conditions orally or in writing. (b) To make any representations or warranties regarding the conditions of goods, their fitness for purpose or any other matter whatsoever.
Copyright, Warranties and other Industrial Property Rights.
The company shall be indemnified by the buyer against any claim by a third party against the company arising out of any goods supplied to or work done for the buyer including any infringements of copyright, patent, trademark or registered design, but only where goods have been supplied or work has been done by the company in accordance with the buyers designs, drawings, details or specific instructions which are discovered to be the cause of such infringements.
The company does not warrant or represent that the goods to be sold will have been manufactured or processed by the company.
The company may act as a principal or an undisclosed agent for any other person or company in the making or performance of the contract for the sale of goods.
Force Majeure
The contract maybe varied or terminated by the company if it is affected by an act of god, war, strike, lockout, fire, flood, drought, tempest or any other cause beyond control of the company whether similar to the foregoing or not. Similarly, the contract maybe varied or terminated by the company if it shall, for any reason, be unable to procure materials or articles required for the performance of the contract. In no circumstances whatsoever shall the company be liable for indirect or consequential loss or damage.
Payment Security
Resincoat Ltd uses Stripe for online payments. Stripe allows us to safely process your credit card payments and complete the financial transactions as securely as possible. For further information regarding Stripe's secure systems please visit their website.
Resincoat Ltd is not liable for any unauthorised access to information supplied by you.
Privacy & Data Protection
To comply with UK Global Data Protection Regulations (GDPR) Resincoat Ltd will not disclose customer information to any third party with the exception of your e-mail address which may be shared with our courier to provide tracking information about your order. All personal and customer data will be stored safely on our secure server which is inaccessible to anyone outside of the Resincoat organisation. We also take measures to secure our site, remain PCI compliant and adhere to all best practices of handling sensitive customer information. For further information please visit our privacy policy.
Contractors & Recommended Installers
The Company/Resincoat may at a customer’s request visit their premises to discuss products which might be suitable for their needs. Resincoat may upon request also recommend and obtain quotes for a customer from a third party contractor who might be suitable to carry out installation or application of products for them but without any warranty or representation by Resincoat in this regard.
The Company does not carry out any services other than to supply its paints, coatings or products and shall have no liability which may arise from inappropriate or negligent installation or application of our products by the customer or any third party. Installation or application shall be the sole responsibility of the customer. If any recommended or other third party contractor is engaged by the customer then the terms of such engagement shall be solely between the customer and such third party as contractor.
Returns
In cases of goods that are faulty, damaged or wrongly supplied please contact Resincoat Ltd on 0113 827 2387. You will be required to send a written returns request to returns@resincoat.co.uk
Please note: all bundle products including, but not limited to, GFP001, GFP002, GFP003, FFP001, LQR001 & LQR004 are sold as complete sets and so we cannot accept returns of individual items
Resincoat Ltd accepts no responsibility for goods damaged or lost in transit.
